Steps to Take When Charged With DUI in Jackson County
Your first court date will usually be at least a month or two from the date you receive the criminal complaint or ticket. However the clock starts running immediately on your right to contest the potential suspension of your Missouri Driving Privileges.
In Missouri you have fifteen days from the date of a chemical test failure to request a Drivers License Hearing. If the Officer marked you down as a Refusal, a Petition for Review must be filed in Circuit Court within 30 days. The Arresting Officer should have served you with a 15-Day Temporary Driver Permit (Missouri DOR Form 2385). The request must be made within fifteen days of service of the form if a test failure ( B.A.C. of .08 or greater ) was recorded or a Petition for Review must be filed within 30 days if law enforcement says you refused to cooperate and submit a sample. Note: Failure to Request a Drivers License Within the time period will result in the forfeiture of the right to review and the automatic suspension of your Missouri Driving Privileges no matter what the ultimate outcome of the criminal case in court.

Jackson County History
Jackson County was once home to the Osage Native American tribe and the earliest white explorers were French fur traders. The Lewis and Clark expedition famously passed through Jackson County in 1804 on their way to the Pacific. Fort Osage was the first US military outpost within the Louisiana Purchase Territory and remained open until 1822. Jackson County became part of the newly admitted State of Missouri on August 10, 1821; it is named for President Andrew Jackson. A statue of Jackson on horseback greets visitors at the entrance of the downtown courthouse. Our future President Harry S. Truman was the presiding judge in Jackson County at the time of the construction of the downtown courthouse in 1934 and was involved in its Art-Deco design. The old Jackson County Courthouse is now known as the Historic Truman Courthouse and is located on the Courthouse Square in Independence. Court is no longer held there, but at the recently-refurbished courthouse at 308 W. Kansas.
